Terms of Service
The agreement between you and Bolimber for using the marketplace and wallet.
Version 2026-09-21 · Draft for legal review. These Terms apply to everyone who uses Bolimber ("we", "us"). By creating an account you agree to them and to the Privacy Policy, the Prohibited Items Policy, the Disputes & Refunds Policy and the Risk Disclosure.
1. What Bolimber is
Bolimber is an online marketplace where people and businesses list physical goods for sale and buyers pay with Bitcoin (BTC), Ether (ETH) or Tether (USDT). We provide the platform, a hosted wallet for each account, and an escrow service that holds the buyer's payment until delivery is confirmed. We are not a party to the sale. The contract for the goods is between the buyer and the seller.
2. Who can use Bolimber
You must be at least 18 years old and able to enter a binding contract. You may not use Bolimber if you are located in, or a resident or national of, a country or region subject to comprehensive sanctions, or if you appear on a sanctions list maintained by the United Nations, the United States (OFAC), the United Kingdom (OFSI), the European Union or the United Arab Emirates. We may restrict access from any jurisdiction where our services are not permitted. Businesses must provide accurate registration details and may be asked to verify them.
3. Your account
Keep your password and two-factor device private. You are responsible for everything done through your account. Tell us immediately at security@bolimber.com if you suspect unauthorised access. One person, one account, unless we agree otherwise.
4. Wallet and custody
Your wallet balance is a record of crypto assets that Bolimber holds on your behalf in pooled addresses under our control. It is not a bank deposit and is not covered by any deposit-guarantee or investor-compensation scheme. We may require identity verification (KYC), source-of-funds information or additional details about a withdrawal destination before processing a transaction, and we may delay, decline or reverse transactions to comply with law, court orders, sanctions or our risk policies. Network fees for withdrawals are deducted from your balance. Crypto transactions are irreversible: check addresses carefully. Deposits of the wrong asset or on the wrong network may be unrecoverable.
5. Buying
Prices are shown in US dollars. When you pay, the crypto amount is fixed at the live rate and moved from your balance into escrow. Escrow is released to the seller when you confirm delivery, when the automatic release period after shipment ends, or according to a dispute decision. You may cancel an order for a full refund at any time before the seller ships it.
6. Selling
You must own the items you list, describe them accurately, ship within 7 days with tracking, and honour the shipping options you offer. You are responsible for any taxes, duties, licences and consumer-law obligations that apply to your sales (including distance-selling and returns rules for business sellers in the EU and UK). Our fees are published on the Fees page and are deducted when escrow is released.
7. Prohibited conduct and items
No illegal, counterfeit, stolen or restricted goods; no fraud, price manipulation, fee avoidance or off-platform payment requests; no abuse of other users; no automated access without permission. See the Prohibited Items Policy. We may remove listings, hold funds, suspend or close accounts, and report to authorities.
8. Disputes
If an order goes wrong, buyers can open a dispute before escrow is released. Our team decides based on the evidence provided, and both parties agree that the decision determines how the escrowed funds are released. See the Disputes & Refunds Policy. Nothing in this section removes your statutory rights against the seller.
9. Fees and taxes
Fees are shown before you commit to a transaction. You are responsible for reporting and paying any taxes arising from your use of Bolimber. Where the law requires, we will report transaction information to tax or regulatory authorities.
10. Content and intellectual property
You keep ownership of listing text and photos but grant us a worldwide licence to display and promote them on and off the platform. Bolimber's name, logo and software are ours.
11. Availability, changes and termination
We may change, suspend or discontinue features, and update these Terms. Material changes will be announced in the app or by email at least 14 days in advance; continuing to use Bolimber after that means you accept them. You can close your account at any time once you have no open orders and a zero balance. We may suspend or terminate accounts that break these Terms; in that case you can still withdraw funds we are legally allowed to release.
12. Liability
To the extent permitted by law: Bolimber is provided "as is"; we are not liable for the conduct of buyers or sellers, for the quality or legality of goods, for losses caused by crypto price movements, network congestion, blockchain forks, or events outside our reasonable control; and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law. Consumers keep all rights granted by mandatory law in their country of residence.
13. Complaints, governing law and disputes with Bolimber
Contact support@bolimber.com first; we aim to respond within 5 business days and resolve complaints within 30 days. [Counsel to complete: governing law and forum by operating entity — see the jurisdiction annex.] Consumers in the EU/UK may also use their local dispute-resolution bodies and, in the EU, the ODR platform where applicable.
Jurisdiction annex (to be completed by counsel)
- EU: consumer rights under Directive 2011/83/EU; MiCA disclosures for crypto-asset services; DSA trader information for business sellers.
- UK: Consumer Rights Act 2015; FCA financial-promotion rules for cryptoassets; Online Safety Act obligations.
- US: state consumer-protection law; arbitration/class-waiver clause to be added where enforceable; state money-transmission disclosures.
- UAE: Consumer Protection Law (Federal Law 15/2020); VARA/ADGM/SCA disclosures depending on licence; note Central Bank restrictions on using foreign payment tokens for goods and services in the UAE.
